Pursuant to the Wills Variation Act, if a testator has not made adequate provision for a spouse or child, the spouse or child can sue the estate for an increased share of the estate.


Beneficiaries can also assert that property and bank or investment accounts which pass to a party by virtue of a joint tenancy are held in trust for the estate.
